Causes of Car Accidents

Over the last several weeks we talked about car accidents caused by the negligence of another person. While most car accidents are caused by negligence there are also motor vehicle accidents caused by other factors as well. There are many other factors that may cause catastrophic or deadly automobile accidents. When reviewing injury cases involving collisions and car wrecks you first need to establish liability. Who is accountable for the accident? Often times there could be other underlying factors such as faulty roads, poor lighting, sign placement or hazardous conditions.

When we drive on our streets and highways we assume that the conditions are acceptable. The state and county is obligated to provide safe roads and highways. As taxpayers they are obligated to provide safe haven. When an accident occurs due to the negligence of the state its important to fully understand your rights. First, you have the legal right to hire legal representation for your accident to seek compensation for all injuries and damages occurring from such accident. You also have the right to seek lawsuit funding for your car accident. If you are currently seeking a lawsuit cash advance an you want our network of lenders to compete for you business, apply online for a personal injury cash advance for your car accident.

As law abiding citizens we sometimes neglect to carry out our rights. We often times assume responsibility and move forward with our lives. This is a common misconception that has been passed down to us, generation after generation. Although we want to be accountable for mishaps, if you are involved in a car accident due to the negligence of another person or entity, you fully have the right to seek immediate compensation.

LawLeaf is an online lawsuit funding company that provides pre-settlement cash advances and structured settlement annuity payouts for car accidents. If you have been involved in a car accident and are seeking a lawsuit cash advance contact us today to have our lenders compete for your business.

Car Accident Information

When you are involved in a car accident due to someone else's negligence, you have certain legal rights. You have the right to seek legal representation for cases involving all sorts of motor vehicle accidents including motorcycle, tractor trailer, SUV, truck and car accidents. You also have the right to seek lawsuit funding for such accidents. Many people are unaware of the correct procedures and processes involved in getting full compensation for their injuries. Why? The fact is that most people that are involved in motor vehicle accidents have never gone through the process before. When you are involved in a motor vehicle accident it can be a very trying time in your life especially if it results in significant injuries and in some cases death.

It is always recommended if you are involved in a car accident due to the negligence of another, you contact a car accident lawyer immediately. There are certain cases in which people tend to "let it ride" because they are unaware of their legal rights or don't fully understand the process. There several other reason why someone may not contact a car accident lawyer after an accident occurred:
  • They believe that all lawyers charge an hourly rate and can't afford a lawyer
  • They believe that they can work out the case on their own without having to get attorneys involved
  • They believe that their insurance company will provide legal representation for the accident
  • They believe that the other persons insurance company will be fair and pay full damages resulting from the accident
When you hire legal representation for a personal injury related case involving a car accident, most lawyers will charge on a contingency fee basis. This mean they do not charge an hourly rate; they only receive payment if they are successful in getting you compensation.

We understand the importance of full compensation and believe that those people that are in a financial bind and need cash now, a lawsuit loan is a good option. A car accident lawsuit loan can help you pay down expenses and bills while your attorney is fighting for full compensation. Oftentimes people will settle prematurely because they are in need of cash. By allowing LawLeaf's network of lawsuit funding lenders to compete for your business it can help you to keep your lawsuit open in hopes for full compensation for your injuries and damages.

When people decide to handle their own injury cases they oftentimes are unaware of the correct procedures and processes to being successful. Some of the more common points are:
  • How to begin processes for a claim
  • How much compensation should you ask for
  • What are the correct processes in building a substantial case
  • How to negotiate with insurance companies
  • What to say to insurance companies
  • How to proceed with a hearing in the event negotiations fail
Whenever dealing with the negligent party's insurance company consider the following:
  • Insurance companies are set-up to make money not lose money
  • They will negotiate a settlement based upon their assessment of the accident
  • Rarely will an insurance company offer you the best settlement up-front
  • In most cases its up to you or your attorney to negotiate a fair settlement resulting from the damages caused by the accident
If you decide to hire legal representation for a car accident you may be eligible for a lawsuit loan. If you are currently seeking lawsuit funding for your car accident we ask you to begin by filling out our online lawsuit funding application or contact our lawsuit funding lenders today.

Prior to sending out our clients applications to our network of lawsuit funding lenders, we first begin by evaluating the case. When our lenders evaluate any type of personal injury case they look at several factors. One being who was at fault and how did the accident effect the victim. There are obviously many other factors that they evaluate and perhaps I will have time at a later date to discuss. There are processes and procedures that takes place prior, during and after a settlement. Whether it be a car accident or slip and fall your attorney will have to follow the correct procedures and processes to assure they give you the best representation available for your accident. Truck Accident Lawsuit Loans

The facts are although car manufactures are putting tons of money into research and development to make cars and automobiles more safe, they are also making SUV's, trucks and Hummers much larger. If you have been involved in a truck accident you understand that its not only devastating to your vehicle but the likelihood of injury increases drastically.

What about the new Mini's and other smaller two door vehicles? Unfortunately with the increase in larger vehicles along with tractor trailers these accidents will be more catastrophic and will result in an increase in death. While most of us use caution when operating a motor vehicle accidents will continue to occur and as a result injury and death is eminent. While no one ever plans on being involved in a car accident, accidents will continue to occur.

What can you do if you are involved in a truck accident or car accident due to the negligence of another? You should first seek medical attention if needed and/or call the police. Take down information such as name, phone number, address, license number, license plates, insurance information and take pictures of the scene if possible; If others have witnessed the accident, you will want to take down names and numbers as well.

Prior to talking with an insurance company you should immediately contact our Maryland car accident lawyers. Typically a lawyer will recommend the best course of action in getting you the compensation you deserve for all damages and injury that has occurred.

If you are currently involved in a lawsuit for a truck accident and seeking a lawsuit funding we ask you to begin filling out our online pre-settlement cash advance application or contact our lawsuit funding companies today. Car Accident Reckless Driving

If you have been involved in a car accident there is a good chance the accident occurred due to reckless driving. Over the last several months we have received many different lawsuit funding cases involving car accidents due to reckless driving. Reckless driving is a serious moving violation for good reason. There are strict laws against reckless throughout the United States mainly because serious injury and even death occurs.

One of the more common reckless driving charges is speeding. The reason why reckless driving claims so many lives each year is because accidents occur with vehicles going well over the posted speed limit and the impact of an automobile to another car or person can be devastating.

Reckless Driving Examples include but not limited to the following:
  • Speeding over a set limit such as over 20 MPH over the speed limit
  • Passing in emergency lanes
  • Racing
  • Failing to give signals
  • Passing a school bus
  • Passing or overtaking an emergency vehicle such as an ambulance or police car
  • Driving Under the Influence of Alcohol or Drugs
  • Driving with Faulty brakes

Car Accident Lawsuit Loans

Over the last month or so I have seen an increase in the amount of calls throughout the United States from clients seeking pre-settlement cash advances for car accidents. The construction on our roads that take place will obvious change traffic patterns.

When someone is driving throughout a construction area you can certainly see how automobile accidents could occur. While traveling on these construction roads you see many people coming to abrupt stops and in some cases if you are not paying attention, you could likely hit someone from behind. The expansion of new roads and highways, different traffic patterns and more congestion can certainly result in more accidents on our roads.

As for many of the accidents that occur, the increase can certainly relate to these types of changes. There are always cases in which someone is victim to a car accident because the person behind them or in front neglect to pay attention to these different changes. Many of these car accidents are a result of:

  • Disobeying traffic signals or posted signs
  • Reckless driving
  • Inappropriate lane changes
  • Not considering a change in weather conditions
  • Drugs or Alcohol (DWI - DUI)
  • Driving while talking on a cell phone
  • Running a red light
  • Trying to pass on a shoulder or an emergency lane
  • Tailgating

Car Accidents Resulting from Drinking and Driving

Anytime a car accident occurs it is a traumatic experience for both parties. While many car accidents throughout Maryland are purely accidental, there are cases in which negligence is just an understatement. I read an article today regarding a car accident that occurred as a result from drinking and driving. Worse yet, the victim was not only the person that was driving the other automobile, but the child that was driving with the intoxicated party. From what the article stated the person that was driving the car with his child was under the influence of alcohol. This is just poor judgment!

Another article that jumped out of me was the case in which a couple allowed a party in their house for their teenage son. Later that night two of the boys that were drinking at the party, drove their car home and crashed. The accident claimed both of the boys lives.

Both of these stories are examples of accidents of poor judgment. While an accident can never be anticipated, accidents such as these two obviously should have never occurred.

Staying at the Scene

If you have been involved in a Maryland car accident the first thing you should do is contact medical help if needed. If both parties are without injury, you should contact police right after the accident has occurred. Our lawyers have represented many car accident claims in Maryland and understand the consequences of leaving the scene of an accident. The law requires that all parties that have been involved in an automobile accident must stay until a report is filed. If a party decides to leave the scene of an accident, it could result in driver license suspensions and the risk of criminal charges.

There are cases in which damages are at a minimum and the exchange of insurance information would be sufficient. If there is significant damages to your car as a result of a Maryland car accident, contact the police, stay at the scene and make sure you take down information from the other party. There are cases in which accidents occur and the guilty party will flee the scene of the accident.

Request drivers license information, insurance information and take down the other persons license plate. Once you have filed a report and you are cleared by police to leave the scene of the accident, you should contact our Maryland Car Accident lawyers immediately.

Our Maryland car accident lawyers have years of experience in handling cases of insured and uninsured motor vehicle accident cases.

Medical Treatment

When evaluating the amount of compensation our clients is entitled there are several different factors. First and foremost, when you are injured in a car accident you should always first seek medical treatment. There are many cases in which you think you may be fine, but quite the contrary. The amount of medical treatment you receive for your injuries is a good indication of how severity of your injury. Most insurance companies have a grade that they use to gage how serious the accident was and what type of settlement you may be entitled too. There are three variations; Slight, moderate and severe. Slight is generally under $3,000 dollars of medical expenses, moderate is $3,000 to $5,000 and severe tends to be over $5,000. Although not all insurances companies rate the same, this is generally a pretty good rule of thumb. The person that has received slight injury is probably going to get less than the victim that has received severe injuries.

When you have been involved in a car accident and are being treated, make sure you always follow your doctors advice. Do not miss treatments and stay within his or her rehabilitation program. Make sure when visiting a doctor you let them know the locations of the pain, the severity of the pain and find out what or what not you are able to do. There are cases in which we represent individuals that lose jobs or wages because they can’t perform their day to day tasks. In this event, you will need to be fairly compensated for these sorts of damages.

No matter the situation you should always consult a doctor after an automobile or other type of motor vehicle accident. There are many cases in which you may feel fine today and next week you are hurting badly. Without immediate attention this could hurt you case in getting fair compensation for you injuries.

LawLeaf is a lawsuit funding company that matches plaintiffs looking for personal injury cash advances to our network of lenders willing to compete for your business. If you are currently seeking a lawsuit cash advance begin by filling out our online personal injury lawsuit funding application or contact our lawsuit funding lenders today.

Maryland Car Accident Compensation

We receive many inquires throughout the year regarding car accidents that occur in Maryland. One of the more common inquiries is how much can I expect to receive in damages for my auto accident? This is a great question because depending upon the injury or damages does it make sense for you to hire a lawyer to handle your claim.

The short answer to the question is, it never hurts to speak with our Maryland car accidents lawyers because the consultation is always free. We also think based upon your accident we can generally tell you what types of compensation you should fight for regarding your motor vehicle accident.

When assessing a car accident in Maryland an experienced lawyer must first prove negligence or wrongdoing. Once negligence or wrongdoing is proven, the lawyer will evaluate and assess how much in damages should a client be paid. During this process, your Maryland car accident lawyer will work with the other persons insurance company to determine if the settlement that they are offering is fair and makes sense. If our attorneys and client believe the settlement is not substantial, we will continue the process of filing the claim through the courts.

It is imperative to have experience in both working with insurance companies and taking cases to court. We are tenacious and we always look to get quick settlements as soon as possible but won't settle for unfair settlements offered by the insurance company.

Some of the different types of compensation include but not limited to the following:
  • Medical expenses
  • Ongoing medical expenses
  • Pain and suffering
  • Loss of wages
  • Loss of job
  • Costs relating to therapy and counseling
  • Out of pocket expenses
  • and so on....

Maryland Car Accidents Involving Teens

I read an article today regarding car accidents in Maryland involving teens. The numbers are a bit staggering but according to this article, some 6,000 teens and young adults died in an automobile related accident in the United States. I commented on text messaging in an earlier post but the distractions that have been reported are far more such as talking on your cell phone, talking to friends in a car or turning the radio. One of the biggest killer on the roads is a driver of a car being distracted. Studies show that close to 50% of accidents are a result of the driver being distracted while operating a motor vehicle.

While its inevitable that accidents will occur on our Maryland highways the statistics are eye opening. Furthermore after studies most teens admit to using cell phones when driving and although there have been laws passed recently that prohibit cell phone use while operating an automobile or other motor vehicle, they are still doing it.

It is obvious that without stricter laws being passed such as loss of license etc. the problem will still exist. When AAA polled 1,000 teens 46% say they text message, 51% say they talk on cell phones and 58% say they drive with friends. I expect these number will increase.

Driving While Texting in Maryland

There are many car accidents throughout Maryland and most of those accidents unfortunately are preventable. I read an article today regarding texting while driving. According to sources there were over 158 billion text messages in 2006 and the number is on the rise. There are some states including Maryland which have tried to pass a law against driving while texting. The only problem is there hasn't been enough data presented to legislators that confirm that car accidents in Maryland are a result of text messaging.

While I do believe that these accidents are occurring in Maryland, without the necessary laws set in place to prevent driving while texting motor vehicle will continue to occur. As for now Washington DC is the only place in which its illegal to text and drive at the same time. As for now, you will receive a $101 dollar fine if caught. They also have a law against hand held cell phones.

My belief is that if passing a law against driving while text messaging can save lives, than the law should be in place. It is important to understand if you have been involved in a Maryland car accident due to someone else text messaging, you should absolutely contact our Maryland car accident attorneys today. While a law has not yet been passed, it is up to the driver to make sure he or she is negligent when operating a motor vehicle. Multitasking such as text messages in Maryland is not using good judgment, hence if an accident occurs due to multitasking, they are liable.

If you have been involved in a MD car accident and seeking compensation for you injury or injuries, please contact our Maryland car accident lawyers today by visiting us at http://www.injurymaryland.com.

Making a Personal Injury Claim For Your Car Accident in MD

I was speaking to a client last week discussing exactly how we are going to file a Maryland personal injury claim for her car accident. A car accident is no different than any other type of personal injury claim. When you are involved in an automobile accident in Maryland there are 3 areas in making a claim. The first area is establishing liability. Establishing liability or determining liability is finding out who exactly if anyone caused the accident and who is legally and financially responsible for the accident occurring. There are other instances in which we can prove the road conditions were unsafe, lack of safety warnings such as signs and other factors as well. Without establishing liability you don't have a personal injury claim. The second area is establishing the amount of damages you are entitled too as a result of the accident. This means how much compensation are you entitled too as a result of the accident? The compensation you can receive for a car accident may include loss of wages, pain and suffering, costs for repairs, medical expenses and other related costs directly resulting from an accident. Our car accident lawyers work exclusively on a contingent basis which means we don't receive payment for your car crash unless we are successful in winning compensation for you.

The final area is determining who is responsible for paying for the damages of the auto accident. Damages may be paid by the insurance company, individual or other entity. No matter the circumstance these are the 3 areas in which our attorneys look at prior to filing a personal injury claim for a car accident.

When evaluating a Maryland car accident attorney make sure of the following:
  • Experience in handling personal injury related cases, specifically car accidents
  • Experience in negotiating fair settlements with the insurance company
  • Experience in taking your injury case the distance if the insurance company decides not to pay full compensation for your injury or property damages
  • Reliable, knowledgeable, aggressive an accessible
An experienced car crash attorney will always fight for full compensation for your injuries and property damages for each single case. If you have been involved in a car accident, we highly recommend you contact our Maryland Car Accident Attorneys prior to speaking with an insurance company.

Our MD injury lawyers can be reached at 410.620.0443 call today for a free consultation.

While we are located in Elkton, MD we are taking cases throughout the state of Maryland. We will represent you if your accident occurred in Allegany, Anne Arundel, Baltimore County, Baltimore City, Calvert County, Caroline, Carroll, Cecil County, Charles County, Dorchester, Frederick, Garrett County, Harford County, Howard, Kent, Montgomery, Prince Georges, PG County, Queen Anne’s, Saint Mary’s, Somerset, Talbot, Washington County, Wicomico and Worcester.

Filing A Maryland Car Accident Claim for a Personal Injury

When people decide to file their own Maryland car accident claims it can be frustrating and bewildering, mainly because it’s not something you do everyday. While most of us have heard about car accident claims from lawyer commercials or advertising, many of us don’t pay attention, mainly because it’s not something you expect will happen to you. The problem is that car accidents don’t discriminate; anyone at anytime can be involved in a car crash. It is critical to understand, if you or a love one is involved in a car accident in Maryland, as a victim you are entitled to compensation to pay for injuries and damages related to the car wreck. Some people find themselves unable to fully understand how to file an injury claim for their accident. If you are one of those people you are among the millions of other people each year that have been in these sorts of accidents.

There are really two viable options you face as a victim of a car accident. The first option is to settle your compensation claim with the insurance company. As everyone already knows, insurance companies are set-up to make a profit, so you’re probably not as likely to receive full compensation for your injury. If you happen to watch the news, search the internet, or read the paper you will see that insurance companies are making all time high profits. This could be related to the increase in insurance rates and the decrease in payouts. If you do decide to work directly with the insurance company you should always take in consideration that their first offer is likely not their best offer.

The second option is to hire a Maryland car accident lawyer that is familiar with handling car accident claims in MD. Why is it important to consider option 2? First, when hiring a lawyer that handles auto accident claims, you know the person that is representing you probably has the experience in dealing with insurance companies. This means they are more likely able to negotiate with insurance company’s to get you full compensation for your injury. Second, the attorney you hire will know the best plan of action in getting you full compensation for your injuries or injury. Third, if you and your attorney feel the compensation the insurance company is offering is unfair, your lawyer can take the claim to court and fight for more money on your behalf. Fortunately you can get all the help you need with the representation from our Maryland car accident lawyers, without paying upfront fees, such as filing fees and court costs. In fact, if we are not successful in getting you compensation for the injury, we don’t receive payment at all. Our Maryland car accident attorneys work strictly on a contingent fee basis which means if you don’t get paid for your accident, our attorneys don’t get paid.

Motor vehicle accident and injury claims are possible for; injury or death resulting from automobile accidents, public transportation like buses or subways, SUV, Tractor Trailers, trucks and other type of vehicles. There are also cases which we represent innocent pedestrians that have been injured or killed by an automobile accident in Maryland.

So what constitutes our clients to receive compensation for their injuries? Compensation is provided for pain and suffering, loss of wages, loss of job, medical expenses, cost for therapy, property damages, out of pocket expenses and cost of transportation to name a few.

While a car accident can be one of the most traumatic experiences you will ever face, it’s important for the victim to fully understand his or her rights. It is an unfortunate event when someone has been injured or killed due to the negligence of another and it’s something that is never expected. It is extremely stressful and a decision to hire the best representation possible could ultimately make or break a family. If you have been injured in an auto accident in Maryland we ask you to contact our Maryland car accident injury lawyers today.

Most people throughout Maryland define impairment as driving under the influence of alcohol or drugs. Although this is true, there are also other forms of impairment that are not alcohol related. Impairment is defined as the inability to perform daily tasks at a normal functioning level. The symptoms of impairment include drowsiness, alter depth perception, excitability, slow reaction time or increased reaction time. While impaired driving is the leading cause of car accidents in Maryland, driving under the influence of alcohol or drugs is not the number one cause for motor vehicle accidents throughout MD. Impairment can be caused by many over the counter drugs such as allergy medicine, pain medications, anti-anxiety prescriptions, flu medicine and cough syrup can cause an individual to become drowsy resulting in delayed reactions and ultimately causing automobile accidents on our streets and highways.

There are ways in which we can avoid these types of accidents. Prior to operating an automobile or motor vehicle if you are taking prescription or over the counter drugs you should do the following:
  • If you are on medications consult a doctor or a pharmacist to learn about the side effects
  • You should never take more than the recommended dose
  • You should always read the directions and warning labels
  • Never mix alcohol or drugs with your prescription
  • Never mix other medications without consulting a doctor or pharmacist
  • You should always be able to recognize these symptoms prior to operating a motor vehicle
When we get behind the wheel of a car most of us are aware of the dangers of operating a motor vehicle and we take necessary precautions when driving. There are many factors in which victims that have been injured in a car accident in Maryland, can't control. For instance, you can't control those individuals who decide to get behind a wheel of a car while intoxicated and/or impaired.

While you can never plan to be involved in a car accident it can happen to anyone at anytime. No matter how cautious you are there are always those individuals that disobey the laws and continue to drive impaired. If you are one of the victims that have been involved in a car accident in Maryland due to the negligence of an impaired driver, contact our Maryland car accident lawyers today.
